The process is as follows:

1. E-mail notification steps

At first, the problem was that the PayPal account was frozen and restricted. Next, the Paypal official will send an email to the seller to inform them. They received a notice from the US court that they suspected that their account was suspected of infringement, so their Paypal account will be temporarily frozen and they will not be able to withdraw or turn over all the funds in it.

In a few days, I will receive another email from American law firm GBC. There is a case number+evidence of business infringement+other legal documents+need to go to the United States to attend within 21 days.

2. The trial stage of the case

It is worth saying that GBC is really smart and heartless. The northern part of Illinois in the United States is the place that pays the most attention to the protection of property rights, and they accept most cases here. Infringement will be dealt with in time without any delay. The plaintiff’s statement will usually be issued one week after the case is established, and the hearing will be held one week later (both parties report).

Most China sellers will not go to the United States to argue with GBC, so GBC will receive the basic judgment order from the court 21 days after the case is established.

3. Trial execution stage

The basic order is usually:

(1) Because the defendant did not participate in the trial, the plaintiff naturally won the case.

(2) The defendant should pay the plaintiff XX million dollars (generally 0-2 million dollars, the specific amount depends on the plaintiff’s application and the judge’s specific trial decision).

(3) Restrict all the seller’s properties in the United States (including those in PayPal account), giving priority to compensation to the plaintiff. (Sellers generally only have one PayPal account, and there will be no real estate or stock bonds in the United States, so the court will usually enforce their funds on PayPal. If the PayPal account has insufficient funds, other related PayPal accounts will be frozen. )

(4) The seller will be forced to close the store. So far, the eBay platform will operate like this, and Amazon can sell normally (the amount of sales will be frozen).

At this point, the process is over, which makes people speechless, but if the seller actively solves it, the final result will not be very bad.

Seller’s solution:

1. Once the PayPal account is frozen, be sure to check the registered email address of your PayPal account immediately to see if it is frozen by a court injunction.

2. An email from GBC will also be sent to the registered email address of your PayPal account, which contains your case number and product link. Click to view the suspected infringing items.

Where 17-1109 refers to the case number. Chrome Hearts refers to the plaintiff Crowe.

3. At this time, you should check the product yourself to see if there is any infringement. GBC infringement lawsuit is not limited to a single Remy, as long as the product has this pattern, it is regarded as infringement. 6. Not attending and not reconciling is the worst plan. The ruling of the American court is valid for 10 years, and you can submit it before the final date. The annual debt increased at the interest rate of 6%-10%. PayPal sellers and holders are always bound by this situation. PayPal will not only be emptied, but also have certain restrictions.
