ORDER GRANTING EX PARTE APPLICATION FOR ENTRY OF TEMPORARY RESTRAINING ORDER [8] Motion for TRO. This matter is before the Court on Plaintiff's Ex Parte Application for Entry of Temporary Restraining Order, Preliminary Injunction, and Order Restraining Transfer of Assets (Doc.8), pursuant to 15 U.S.C. § 1116, Fed. R. Civ. P. 65, 17 U.S.C. § 504, and The All Writs Act, 28 U.S.C. § 1651(a), by Plaintiff, ROLLER RABBIT LLC ("Roller Rabbit" or "Plaintiff'). Plaintiff asks the Court to enter a Temporary Restraining Order and an order restraining the financial accounts used by Defendants. As discussed below, Plaintiff has satisfied the requirements for issuance of a Temporary Restraining Order. As further set forth in this order, To obtain a Temporary Restraining Order, a party must demonstrate (1) a substantial likelihood of success on the merits; (2) that irreparable injury will be suffered if the relief is not granted; (3) that the balance of the hardship tips in the plaintiff's favor; and for that the public interest would not be disserved by the issuance of an injunction. As further set forth in this order, Accordingly, the Court, having considered the Motion, and having found good cause, it is ORDERED that the Motion is GRANTED, and a Temporary Restraining Order is entered as follows: 1. all persons in active concert or participation with any Defendant having notice of this Order are hereby restrained and enjoined until further Order of this Court: As further set forth in this order, BOND TO BE POSTED Pursuant to 15 U.S.C. § 1116(d)(5)(D) and Federal Rule of Civil Procedure 65(c) Plaintiff shall post a bond in the amount of twenty-five thousand dollars ($25,000.00) as payment of damages to which Defendants may be entitled for a wrongful injunction or restraint, during the pendency of this action, or until further Order of the Court, and in the Court's discretion, the bond may be subject to increase should an application be made in the interest of justice.
