MINUTE entry before the Honorable John Robert Blakey: Plaintiff filed an amended complaint, which seeks to sue 10 separate defendants for trademark infringement, see [20], [23]. But the exhibits attached to the amended complaint confirm that Plaintiff's buys of the allegedly counterfeit products came, not via the fully interactive websites allegedly operated by the Defendants, but through purchases solicited and arranged via personal messages. See [22]. As before, this evidence undermines Plaintiff's jurisdictional allegations. See [18]. The Court thus dismisses the amended complaint [20] and denies Plaintiff's motions for electronic service of process [24] and for a temporary restraining order [25]. MINUTE entry before the Honorable John Robert Blakey: Plaintiff has sued 12 separate defendants alleging trademark infringement, see [1], [9]. Joinder of multiple defendants in a single trademark infringement action remains appropriate only if the claims against the defendants are asserted "with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences," and a common question of law or fact exists as to all defendants. Fed. R. Civ. P. 20(a)(2)(A)-(B). In this regard, Plaintiff alleges that "E-commerce stores operating under the Seller Aliases share unique identifiers, establishing a logical relationship between them and giving rise to the inference that Defendants' counterfeiting operation arises out of the same transaction, occurrence, or series of transactions or occurrences." [1] at 4. This is a legal conclusion, which the Court need not accept. Plaintiff also alleges that the defendants "often share unique identifiers, such as templates with common design elements that intentionally omit any contact information or other information for identifying Defendants or other aliases they operate or use" and "include other notable common features such as use of the same registration patterns, accepted payment methods, check-out methods, keywords, advertising tactics, similarities in price and quantities, the same incorrect grammar or misspellings, and/or the use of the same text and images." Id. at 26. Plaintiff further alleges that defendants' counterfeit products "bear similar irregularities and indicia of being counterfeit to one another, suggesting that" they "were manufactured by and come from a common source and that Defendants are interrelated." Id. To support these conclusory allegations, Plaintiff submitted a separate memorandum in support of joinder, which explains that the 12 named defendants: (1) all operate through the same distinct process of sales using Instagram to market; (2) they all list a WhatsApp number in their Instagram bio and direct users to message them using that number; (3) after successfully converting Instagram traction into WhatsApp messages every Defendant goes on to offer a direct sale to the consumer through sharing images of stock and their PayPal details for payment using 'friends and family'; (4) each of these Defendants offers for sale identical counterfeit Fendi Regular Selleria Baguette, a niche product rarely counterfeited due to the complexity of its hand stitching elements; and (5) and each Defendant offers the product at closely aligned prices." See [12] at 2. The allegations and representations arguably support the joinder of the defendants here. But the attachments to the memorandum and to the declaration of Nicolas Lambert, undermine the allegations concerning personal jurisdiction as they show that Plaintiff's buys of counterfeit bags came, not via the fully interactive websites allegedly operated by the Defendants, but through purchases solicited and arranged via personal messages. See [11]. Plaintiff's test buys remain insufficient to support the exercise of personal jurisdiction over the identified foreign Defendants. See, e.g., Walden v. Fiore, 571 U.S. 277, 285 (2014) ("the plaintiff cannot be the only link between the defendant and the forum"); Expeditee LLC v. Entities Listed on Exhibit 1, No. 21 C 6440, 2022 WL 1556381, at *4 (N.D. Ill. May 17, 2022) ("Plaintiff claims that, as part of its preliminary investigation, it purchased infringing products from the Moving Defendants that the Moving Defendants shipped to Chicago. Such sales on their own are insufficient for the purposes of personal jurisdiction, for Plaintiff has not identified evidence of any transactions involving an allegedly counterfeit product between the Moving Defendants and Illinois customers, other than the 'test buys.'"). The Court thus dismisses the complaint and denies Plaintiff's motion for electronic service of process [13]. Because this evidence also undermines Plaintiff's likelihood of success on the merits, the Court also denies Plaintiff's motion for a temporary restraining order [14]. The Court grants Plaintiff's motion to seal [8] and strikes the 10/1/25 Notice of Motion date as to all motions. If Plaintiff can, consistent with its obligations under Rule 11, amend its complaint to allege facts to support the joinder of defendants in this suit and to support the exercise of personal jurisdiction over each named defendant, it may file an amended complaint by 10/22/25. Consistent with this Court's standing order, Plaintiff shall provide courtesy copies of any filing that has attached to it exhibits totaling 50 or more pages. Mailed notice. 翻译
