MINUTE entry before the Honorable Edmond E. Chang: (1.) The Plaintiff's motion [22] for TRO is denied in large part. On review of the alleged infringement, R. 20-3, it is not at all clear that the infringing product's **ornamental** features infringe the design patent. The general curved shape of the long-side length of the product, and the curved shapes on the ends of the product, R. 20-3 at 2-5 are functional shapes to hold the top of hats and to wrap around the sides of hats, R. 20-3 at 6 (showing product in advertising photo). Indeed, the radii of curvature of the various curves do not appeal all that similar. So the requests to enjoin the site and to restrain assets are denied. The request for expedited discovery to determine financial accounts and assets is denied. The only aspect of the motion that is granted is to authorize early discovery for identification purposes, that is, the authority to issue subpoenas to obtain information on the identification and contact information for the Defendant. (2.) The motion [21] for alternative service is also denied for now. Given the absence of a clear showing of infringement, there is no particular reason yet to characterize the Defendant as a patent infringer who would evade service. But the results of the early discovery on contact information might provide justification to serve by alternative means. (3.) Given the absence of a clear showing of infringement, the basis to seal is undermined. The Clerk's Office shall unseal all filings on this docket. (4.) The Plaintiff may issue early discovery on identification. The tracking status hearing of 10/17/2025 is reset to 11/21/2025 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called).
