Page 2 of Plaintiff's motion states "Defendant sells the Infringing Products through Amazon.com, under the name, TYT-4WD (Seller ID: A27TS7IWE8XWH2, https://www.amazon.com/sp?ie=UTF8&seller= A27TS7IWE8XWH2)." But this link takes the court to Amazon's customer service page. The link provided in the complaint, Dkt. 1, para. 7, takes the court to a storefront by seller Hangzhou Loutian Import and Export Trade Co., Ltd. not one by TYT-4WD. None of the products displayed on the link found in the Complaint are a Towing Device embodied in the '973 Patent. It is true that Exhibit 1 to the motion for a TRO [Dkt. 12-4] contains screenshots of items for sale on TYT's storefront, including an adjustable trailer hitch ball mount sold by Defendant TYT and details from an order placed in June 2025 for delivery to an address in Lockport, Illinois. While these screenshots link to a live storefront by TYT, the submissions as a whole do not give the court confidence that it should take action based on ex parte filings. Rather, an opportunity for adversarial presentation would be helpful before deciding on likelihood of success for the extraordinary relief of a TRO or Preliminary Injunction. Were the court inclined to issue a restraining order, however, it would not restrain any assets and would require a deposit of far, far more than the $1,000 surety bond suggested in the motion.
