Plaintiff requests that the court seal the complaint and plaintiff's exhibits "until such time as the Court holds a hearing on Plaintiff's anticipated Motion for Preliminary Injunction." Id. at 1. Plaintiff seeks to prevent defendants from learning about this action because if the defendants learn of this action prior to a preliminary injunction hearing, defendants may take steps to "conceal, destroy, and/or alter records relating to the infringing products." Id. at 2. However, under Federal Rule of Civil Procedure 65(a)(1), "[t]he court may issue a preliminary injunction only on notice to the adverse party." Thus, plaintiff cannot seek to prevent defendants from learning about this suit until this court holds a hearing on a preliminary injunction motion, as issuance of a preliminary injunction requires notice to defendants.
