MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed the plaintiff's supplemental memorandum on joinder 9 and determines, within its discretion, that plaintiff has failed to satisfy its burden to show that joinder of 154 defendants is proper in this matter under Fed.R.Civ.P. 20(a)(2) and 35 U.S.C. §299. See Estee Lauder Cosms. Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, 334 F.R.D. 182, 185 (N.D.Ill. 2020) (noting that "[plaintiff] bears the burden of demonstrating that joinder is proper"); H-D U.S.A. v. Partnerships & Unincorporated Associations Identified on Schedule "A", No. 21-CV-01041, 2021 WL 780486, at *2 (N.D.Ill. Mar. 1, 2021) ("The Seventh Circuit has recognized the broad discretion that district courts have in remedying misjoinder, so long as the court's decision avoids unnecessary harm to the parties."). Beyond alleging that the over 150 defendants are infringing upon plaintiff's copyrights and patents, which alone is insufficient to establish the propriety of joinder, see Estee Lauder, 334 F.R.D. at 187; 35 U.S.C. §299(b), plaintiff argues that early evidence indicates that defendants "share a number of operative facts, such as, but not limited to, potential common ownership, common geographic operations, similar methodology in operation and, apparently identical channels of procuring counterfeit goods." (Dckt. #9 at 8). For the same reasons as expressed by the Court in a case involving this same plaintiff (making identical arguments), the Court finds that "these arguments fall short of establishing a logical relationship among the defendants. sufficient to show they are part of the same transaction, occurrence, or series of transactions or occurrences." Prime 4 Seasonings, LLC v. Partnerships & Unincorporated Associations Identified on Schedule A, No. 25 CV 1036, 2025 WL 2549266, at *2 (N.D.Ill. Feb. 12, 2025); see also H-D U.S.A., 2021 WL 780486, at *3 ("Combining hundreds of unrelated defendants in one case creates a burden on courts since courts must evaluate the evidence submitted in support of liability and, eventually, apportion damages among the parties."). Plaintiff is granted leave to file an amended complaint consistent with this order, along with a memorandum explaining specifically why each defendant is properly joined to all of the others, by 11/7/25.
