Although the stated grounds for denying plaintiff's motion for default as to defendant 209 "hokozan" were in error, plaintiff has now filed an amended complaint that does not name this defendant. Accordingly, all claims against defendant 209 are dismissed. Motion by defendant 209 to set aside entry of default 94 is denied as moot, as no default was against this defendant. Plaintiff is directed to take immediate steps to ensure that any and all asset restraints imposed on defendant 209 arising out of the claims asserted in this case are dissolved. Plaintiff's motion for entry of default and default judgment against the defendants identified in Amended Schedule A 70 is granted as follows. While plaintiffs defendants' default establishes their liability as alleged in the complaint, nothing in either the complaint or plaintiffs' motion attempts to quantify or even estimate the profits these defendants made from their unlawful conduct or the revenues plaintiff lost, both of which factors plaintiffs acknowledge as relevant to the appropriateness of statutory damages. Pl.'s Mem., ECF 71 at citing Sara Lee v. Bags of New York, Inc., 36 F. Supp. 2d 161, 165-167 (S.D.N.Y 1999). Moreover, at least one defendant offered evidence that its liability is based on a single infringing saleto plaintiff's investigatorof an item sold for $40.00. ECF 94 at 5. Under these circumstances, even assuming willful infringement and considering the need to deter future misconduct, I conclude that plaintiff's request for an award of $150,000 per defendant is excessive. Default judgment will be entered in the amount of $6,000 per defendant. Plaintiff is directed to submit their updated proposed final judgment order to this court's proposed order e-mail inbox.
