Durkin: Defendants have moved the Court to certify for interlocutory appeal the following two issues: (1) personal jurisdiction; and (2) whether service of process was proper. To certify an issue for interlocutory appeal there must be a "substantial likelihood" of reversal. See Fund Recovery Servs., LLC v. Kitchen, 652 F. Supp. 3d 942, 944 (N.D. Ill. 2023). Defendants concede that a reversal of the Court's finding of personal jurisdiction will require the Seventh Circuit to "revisit" its decision in NBA Properties. v. HANWJH, 46 F.4th 614 (7th Cir. 2022). See R. 119 at 10. Because the Court's personal jurisdiction finding is securely based in the law of the NBA Properties decision, there is no basis to find a substantial likelihood that the Court's finding of personal jurisdiction would be reversed, and so there is no basis to grant interlocutory appeal on that issue. As to the issue of service of process, Defendants argue that there is substantial disagreement about whether service of process by email on a party in China comports with China's objection to service by "postal channels." However, Plaintiffs point out in their response brief that the Court also permitted service of process by publication in this case, which Plaintiffs accomplished. If service of process was properly accomplished by publication, this appears to moot the issue of whether service by email was proper. Defendants failed to file a reply brief on this motion on 5/16/2025 as scheduled, so the Court does not have the benefit of their response regarding the relevance of the fact that service was accomplished by publication. Defendants have until 5/27/2025 to file their reply brief addressing the service of process issue, otherwise the Court will deny the motion for interlocutory appeal. Mailed notice. 翻译 |

Specifically, the Defendants argue that the service by email authorized by the Court is prohibited by the Hague Convention. This Court has rejected this argument in several previous cases. See Klauber Bros., Inc. v. Partnerships, etc., in Schedule "A", 2024 WL 182209, at *3 (N.D. Ill. Jan. 17, 2024); Porter v. Scott Sports SA, 2023 WL 8190381, at *2 (N.D. Ill. Nov. 27, 2023) (citing Strabala v. Zhang, 318 F.R.D. 81, 114 (N.D. Ill. 2016); Viahart LLC v. Suzhou Everich Imp. & Exp. Co., 2021 WL 3857787, at *4 (N.D. Ill. Aug. 30, 2021); Hangzhou Chic Intelligent Tech. Co. v. Partnerships, etc. on Schedule A, 2021 WL 1222783, at *3 (N.D. Ill. Apr. 1, 2021). As have many other courts in this district.
