Schedule A may be temporarily sealed and the motion to file other documents under seal 11 is granted. But plaintiff may not proceed under a pseudonym. Sealing Schedule A suffices and the public right to know who is using the courts otherwise outweighs plaintiff's interest in secrecy. The clerk shall immediately recaption the case Norman Duenas v. The Partnerships, etc. The motion for excess pages 10 is granted. The motion for an ex parte TRO 8 is granted in part. Plaintiff must resubmit a proposed order that is limited only to the copyrighted works for which plaintiff has submitted evidence of infringement. The court will not enter an injunction covering works for which plaintiff has not demonstrated any likelihood of success. The proposed order submitted by plaintiff lists only one Copyright Registration No., VA 2-381-326, which does not correspond to any Registration No. in the submitted evidence. That work is registered to Angus Setyawan, not plaintiff Norman Duenas. As to the works identifiable in the evidence, plaintiff's motion is granted. The submitted evidence establishes a likelihood of success on the merits as to those works, the harm to plaintiff is irreparable and an injunction is in the public interest because infringement interferes with the plaintiff's ability to control its intellectual property. Those rights cannot be fully compensated by money damages. There is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective, perhaps the most effective, way to communicate with defendants. Expedited discovery is warranted to identify defendants and implement the asset freeze. If any defendant were to appear and object, the court will take a fresh look at the asset freeze, joinder, and personal jurisdiction. The court finds that security in the amount of $50,000 is sufficient to secure the injunctive relief. No appearance on 7/10/24 is necessary.
