Chang: Pursuant to the notice of voluntary dismissal, under Federal Rule of Civil Procedure 41(a)(1)(A)(i), the case is dismissed without prejudice. ***BUT IF THE CASE IS REFILED, then the Plaintiff must state on the Civil Cover Sheet that it is the refiling of a previously dismissed case and provide this case-number information, so that the case can be assigned to Judge Chang. See NDIL Local Rule 40.3(b)(2). Having said that, it is permissible to refile the case with a subset of defendants who are properly joined, rather than refile the case with exactly the same defendants (which is the functional equivalent of filing an Amended Schedule A in this case).
