Per the District Court's referral [[73], [74]], this Court has authority over "discovery supervision, including the authority to set deadlines, and settlement." Plaintiff filed an amended complaint on June 16, 2025 that consisted of six counts [140]. On June 30, 2025, Defendants filed a motion to dismiss for failure to state a claim relating to three of those counts (Counts One, Five, and Six) [[146], [147]]. Though the parties have indicated that they are engaged in settlement talks and believe that alone is a reason to continue the stay on discovery, the Court does not believe so. OPINION AND ORDER: For the reasons set forth in the accompanying opinion, Defendants' motions for judgment on the pleadings [80] and to vacate the preliminary injunction order [90] are granted. If Plaintiff believes that it can amend the complaint consistent with the Court's opinion, it has until 6/16/2025 to do so. The Court sees that Plaintiff has filed a "letter extension" requesting that the status in this matter scheduled for 5/21/2025 be postponed until "at least the second week in June." [117] While the Court is sympathetic to Plaintiff's personal matters, this is the sixth extension of time requested by Plaintiff in four months. [86][94][96][98][102]. Four of those extensions of time delayed the briefing of the case-dispositive issues on which the Court has now ruled against Plaintiff. The Court therefore will not be entertaining any additional requests for an extension of time. Defendants are entitled to have this matter concluded. Plaintiff's counsel may confer with Defendants' counsel and find an alternate status date between now and 5/21/2025 that works for both sides; appearances by telephone will be permitted. If no mutually convenient date is available, each party may submit a written status report of up to 2 pages in length between now and 5/21/2025. Plaintiff is asked to state in its status report whether it intends to amend the complaint.
