MINUTE entry before the Honorable Lindsay C. Jenkins:Plaintiffs have filed two motions that relate to certain Defendants' request to dissolve the preliminary injunction. As explained, the Court was concerned about the asset restraint and directed Plaintiffs to confer with Defendants about an asset modification if more time was needed to resolve the preliminary injunction. Plaintiffs have pointed out through their filings, however, that certain basic discovery is outstanding, which is needed to properly address the matter of the preliminary injunction. This apparently includes Defendants' Rule 26(a)(1) disclosures (due in July), which is troubling to say the least. In light of this posture, the briefing schedule at 78 is stricken and the motion to extend those deadlines 82 is also granted. The Court will first resolve the motion to compel and at the appropriate time set response dates for the motion to dissolve. Defendants' response to the motion to compel is due by September 14, 2024. The matter is set for a telephonic status conference September 24, 2024 at 9:00 a.m. and the parties are to file a joint status report as to their efforts to resolve the discovery disputes by September 19, 2024. Plaintiff's motion for a preliminary injunction [26] as to certain defendants is granted. Plaintiff's filings establish that it has acted expeditiously to protect its interests and that there remains a significant risk Defendants will transfer relevant assets beyond the Court's reach. For these reasons, as well as the reasons provided in the whole of Plaintiff's filings and as stated by the Court in connection with entry of the TRO, the Court is persuaded that Plaintiff has satisfied the requirements for a preliminary injunction. In addition, the Court finds that the balance of harms favors Plaintiff and that a preliminary injunction serves the public interest by, among other things, protecting consumers from the marketing of counterfeit goods. Plaintiff has also certified and established [30] that it provided electronic notice to defendants of the pendency of this case and provided a link to a website containing relevant case documents, but no objection to the motion for a preliminary injunction has been filed on behalf of any defendant.
