MINUTE entry before the Honorable M. David Weisman: Magistrate status hearing held. Discussion held as to representation of the 23 non-participating/non-responsive defendants. New attorneys may be added to represent the 17 defendants that Mr. Men currently represents. Discussion held regarding issues associated with the close of fact discovery. Plaintiff argues the parties agreed to a fact discovery close date of 6/15/25 and that the first time Plaintiff heard of Defendants' issues associated with Plaintiff's discovery requests was in the status report filed on 9/29/25 (Dkt. #[306].) The Court acknowledges that it believed the parties were on track to have completed fact discovery by the end of September, but it further acknowledges that the Court did not set a fact discovery close date. Accordingly, the Court will consider the two requests for production Defendants assert are outstanding. Regarding the models referred to in Defendants' RFP # 60, production of the 4 physical samples provided by Plaintiff as prior art, Plaintiff's counsel to inquire of its client whether such models currently exist and are available. In the Court's broad discretion and due to the lack of burden to Plaintiff, the Court directs that Plaintiff shall provide the relevant physical models Defendants are seeking in RFP # 60, if they exist. By 10/6/25, after conferring with Plaintiff, Defendants to submit a proposed order to Proposed_Order_Weisman@ilnd.uscourts.gov regarding Defendant's RFP # 60; Plaintiff to respond by 11/4/25, if the models exist. If they do not exist, Plaintiff shall certify that fact. Discussion held regarding Defendants' request for information related to the patent invalidation proceeding in China. The parties agree that the Chinese proceeding does not directly affect the instant case, but Defendants seek Plaintiff's admissions of fact in that proceeding because Defendants assert Plaintiff did not provide all prior art to the USPTO in its patent application. The Court indicated that to the extent Plaintiff made any admissions in a foreign jurisdiction, any relevance to the instant case would require an understanding of the effect of any admissions under Chinese law. The Court further notes that Defendants could have sought the information directly from China but apparently did not. For both these reasons and in its broad discretion, the Court will not order that Plaintiff respond to this request for production regarding information from the Chinese invalidation proceeding. Fact discovery to close 11/4/25. For the reasons discussed in open court, and as briefly summarized herein, the motion 264 is granted in part. As to Plaintiff's RFPs 1-4, defense counsel indicated that not all documents produced apply to all defendants. Defendants are directed to re-produce documents responsive to RFPs 1-4 and identify which documents apply to which defendants. As to RFPs 9-12, Defendants to supplement their response by giving sufficient information to identify which documents apply to which defendants. As to RFP 13, the request is overly broad (all things related to each financial account), and Plaintiff narrowed the request to seek documents necessary to identify the relevant financial accounts. Defendants to supplement their response to RFP 13. Regarding RFPs 5-8 and 14, seeking documents to demonstrate knowledge of Plaintiff's patented product and willfulness, Defendants are directed to supplement their responses. Regarding Plaintiff's general concern that Defendants failed to retain documents, that issue is not yet fully developed; Plaintiff may seek further relief in the future, if necessary. As to RFPs 10-12, these are duplicative, so no additional relief is granted. As to RFP 20, physical exemplars, Defendants to indicate who manufactured the three exemplars provided to Plaintiff. Defendants may provide confirmation of the manufacturer(s) in writing or the parties may accomplish the exchange of information in a meet and confer. As to RFP 19, model names and numbers and differences, Defendants to supplement their answer to clarify which documents apply to which defendants. As to Interrogatories #2 and #3, in its discretion, the Court directs Defendants to supplement their responses to provide a specific written response as to each defendant and identify any corresponding documents that have been produced. As to Interrogatory #4, and all interrogatories, Defendants must provide a separate response for each defendant. Defendants to provide their supplemental responses by 5/30/25.
